What is a Trust Deed?

A Trust Deed is for Scottish residents ONLY and is a voluntary arrangement which allows you to come to a binding arrangement with your creditors to repay your debts in part or in full. You could be DEBT FREE in 36 months.

A Trust Deed is NOT a court process but it is a legal contract and is therefore less formal and less expensive than sequestration (formal bankruptcy). A Trust Deed (when Protected) is binding on ALL creditors (even those who don’t agree to it) and prevents them from taking ANY further legal action to enforce payment of the debt.**

Example of a client on a Trust Deed:

Before the Trust Deed
Mr Winter owed £33000 to various unsecured loans and credit cards, and was paying £450 per month from net earnings of £1448. He started to fall behind in payments and he was at serious risk of losing his property.

After signing a Trust Deed
Mr Winter now pays £232 and his property is protected as he has no equity. He will only have to pay back £8,352 over the three years - £24,648 is WRITTEN OFF!!

A trust deed may affect your credit rating & may remain on your file for up to 6 years. A fee may be applicable depending on suitability and qualification.

*As long as the terms of the agreement are adhered to
** If you breach any of the terms within the agreement the trustee can apply for your trust deed to be brought to an end and your debt to be transferred back to you.
